Gov. Scott: Will Pursue Drug Testing State Employees Case on Appeal

First, an Orlando judge ruled drug testing welfare recipients unconstitutional. Now, federal judge Ursula Ungaro from Miami has ruled Governor Scott's drug testing of state employees is also unconstitutional.

The American Civil Liberties Union of Florida and another state union challenged Governor Scott's Executive Order from last year to drug test state employees. ACLU-FL said it violated fourth amendment rights against unreasonable search and Thursday Ungaro agreed.

ACLU-FL spokesman Derek Newton said, "We're very pleased of course that the judge agreed with our position that the state cannot subject employees to drug tests without reasonable suspicion."

In a statement, Governer Scott said, "I believe that drug testing state employees is a comon sense means of ensuring a safe, efficient, and productive workforce... I respectfully disagree with the court's ruling and will pursue the case on appeal."
